The MHRA said: "We are not aware of any exemption in medicines legislation, which excludes nicotine in tobacco from falling within medicines legislation."
And in answer to the question: "Are you aware of any legislation other than the Medicines Act that could exempt a nicotine delivery product from the provisions of the General Product Safety Regulations 2005?" The Tobacco Policy Officer at LACORS said: " ... my limited knowledge has been exhausted" So, there appears to be no known exemption by regulators for tobacco products. As Gillian Merron MP said the government wants a level playing field then there's a strong case for acceptance of the same risks for all nicotine containing products. I believe we should campaign for enforcement of equal regulation requirements for all nicotine products. This has got to be one of our main strong points - we agree that an equal playing field is required and insist they implement it. |
